1. Definition
  • 'Condition' means the standard terms and conditions of sale set out below, including any special terms and conditions agreed in writing by us
  • 'Contract' means any contract for Goods made between you and the Company
  • 'Goods' means the packaged products or services which we shall supply in accordance with these Conditions

  1. Pricing & Offers

The team at FluxTech Lighting Ltd work hard to ensure that prices listed and technical specification information is accurate at the time of purchase. However, we are entitled to make amendments to the price to take into account any increase in our supplier's prices or the imposition of any taxes or duties, or if due to an error or omission the price published for the goods is wrong whether or not the order has been confirmed. In this unlikely event, we cannot be held responsible for any inaccuracies at any time. Please note that your computer may display old pages from our site which are stored in your own computer's memory from previous visits - it is important you refresh your browser when viewing any pages on our web site to see the current prices and goods available. Any price changes will be advised and agreed prior to accepting your order.
Where FluxTech Lighting run additional offers and voucher promotions, these may only be used singularly and not in conjunction with one another unless explicitly stated. This includes any cashback, discount code or trade account related discount. Please note that before accepting your order, if Victorian Plumbing discover you are not entitled to use of the code, or do not meet any or all terms and conditions for a particular codes use, we may reject your order or process without benefit or reduction.
Percentage saving calculations can be calculated using a manufacturer recommended retail price and the current available price for an item, or the previous sold as price. Please see additional pricing information for information of product prices after sale events end.
FluxTech Lighting reserve the right to withdraw an offer, whether voucher code or reduced price, at any time.

  1. Security

We realise that the internet is based on trust so we make security our number one priority. Our commitment to this will remain prominent for the future. Your credit card details are sent to the banks secure servers whilst the order is processed. No card data is saved and is not visible by any member of staff. Our web server uses GEO, an independent third-party organisation that provides you with proof that our secure web server is genuine. At no point are your credit card details sent over using an unsecured connection. Although some customers may be eligible to receive remarketing messages based on their browsing activity, this is intended to help those customers find the products they want easier. These emails are sent via a cookie-based opt-in system by a third party, we do not collect or store any email addresses. If you receive any emails you are not interested in receiving, please click 'unsubscribe'.

  1. Delivery & Collection

All delivery options and charges can be found on our Shipping and Returns page. Please note that delivery timetables are best estimates, and may be subject to change as due to seasonality, weather and other non-specified factors. All prices include VAT. For orders containing multiple items, you will be charged one fee based on the collective weight of your order, unless you specifically request specialist delivery arrangements.
Our deliveries are usually handled by Royal Mail, UPS or on larger orders, one of our pallet courier partners. Once collected from our dispatch warehouse, all orders are the responsibility of those drivers and staff. We are unfortunately unable to give any special delivery instructions to drivers e.g. leaving products with neighbours or in sheds. Nor are we responsible for any delays the couriers or delivery companies experience. In instances where goods go missing, we have to allow 30 days in order for us to be able to successfully claim from the carrier.
When your order arrives at your address, you will be given the opportunity to check and sign for the products. During delivery, we recommend a visual inspection of your order on arrival for any obvious damages, and to ensure that all products ordered are present. You are not expected to check every item before signing for the delivery. 
Once you receive your items, please do not store them away for later inspection, as if any goods received are damaged, faulty or incomplete, you must notify us within 48 hours of delivery via email or telephone, quoting your ORD number for reference. Please open each box and check thoroughly for damages. If we are notified within the given time frame, we will then organise a replacement and collection. In any situations in which customers have adhered to terms and conditions, yet have received goods that are incorrectly supplied or damaged in transit, FluxTech Lighting will replace goods free of charge. Please note that in some cases, a courier will refuse to collect and we will be unable to organise a collection, for example in the case of broken glass or pottery.
Upon signing, responsibility for these products passes on to you, and any risk of damage or loss is assumed by the purchaser. We are not responsible for any goods received or unpacked by anyone other than the purchaser, so please ensure that person is present to check and sign for the goods at the supplied delivery address.
Please do not fit any damaged goods, as we will be unable to replace or refund damaged items which have been installed. If you find your goods are damaged, please get in touch with us and we'll do our best to help.
All damaged goods, wherever possible, must be returned in their original packaging. For international buyers, we cannot be responsible for any postage cost if the item is found to be faulty or damaged. In instances of international orders, product guarantees which depend on British manufacturing standards or assume the end user has a British Standard water system are no longer applicable.
Please be aware that we cannot be held responsible for any loss or damage incurred due to errors made by the purchaser during checkout, for example entering incorrect address details, so please ensure all information is correct before processing your order.
If you fail to take delivery on the date agreed, then we reserve the right to charge for any subsequent deliveries.
We advise against booking any installers, or engaging in preparatory work until full receipt and inspection of your goods, and will not be liable for any tradesperson costs, consequential loss or compensation in any way. Delivery timescales are given as estimates in good faith, but cannot be taken as precise or exact information.
We will not liable for any electrician’s costs, consequential loss or compensation in any way.
Our out of stock items are listed with an estimated timescale. These are dates estimated by our suppliers, and are subject to change. We will confirm when an item is back in stock via either telephone or email, and then action can be made for your chosen delivery method.
If goods are ordered over the weekend or bank holiday, please be aware that the order date is taken as the next available working day for delivery purposes.
When goods are collected from the FluxTech Lighting dispatch warehouse they become the responsibility of the designated courier. We cannot be held responsible for any delay's that the courier experiences.
For standard pallet deliveries, the responsibility of disposing of delivery packaging materials, such as pallets lies with the customer, though we do have additional delivery upgrades where pallets can be disposed of as part of the delivery service.

  1. Cancellation Rights 

You have a right to cancel your order before despatch or within 30 working days after the date of delivery by either calling us, or sending written notice of cancellation to:

or emailing us at info@fluxtechled.com quoting your order reference number. We will refund you the cost of the unwanted item within 30 days. Once you receive the cancelled order please return the item back to us within seven days of receiving the parcel.
This right of cancellation does not apply where Goods are specifically made to your specification or personalized at your request.
After 30 days from the day after the Goods have been received, you will not be able to cancel the Contract. We still may offer a credit note for goods that are unused, and in their original packaging. Please call us as early as possible to discuss.
All goods, wherever possible, must be returned unused and in their original packaging. We cannot refund goods that have been damaged whilst in your possession.
We are not responsible for any return costs for unwanted items, you will need to arrange for the shipping yourself and ensure their safe return.

  1. Warranty and Liability
    Most products available from FluxTech Lighting are supplied with a 12 – 24 months manufacturer's warranty.
  1. General

Please note that all orders placed through our website are subject to FluxTech Lighting accepting said order, at which point a contract is formed between both parties and the goods are dispatched. Title and ownership of goods will pass to the customer on delivery. Point of accepting the order is considered to be the point of process, picking and packaging at our warehouse or distribution location.
All pictures on our website are the best indication we can give of the original item and are for illustration purposes only.
On occasion the manufacturer may make small changes to the design of a product, due to this, the item/items you receive may have small differences to the picture displayed on the website. The colour of goods may vary slightly from that shown on the website due to limitations of browser software and monitors.
All products are subject to stock availability at the time of ordering. While every effort will be made to ensure that all items shown are in stock we offer no guarantee of availability and this electronic publication does not constitute an offer of sale.
The Contract and Conditions shall be governed by the laws of England, and you agree to submit to the non-exclusive jurisdiction of the English courts.
Any notice required or permitted is to be given by either party to the other under the Conditions these shall be in writing and addressed to the other party and delivered to the address provided at the time the order is confirmed or any subsequent or alternative address which one party may notify to the other from time to time.
The terms and conditions do not affect your statutory rights.
These terms will apply to all your purchases of items from the retail section of our Web Site, whether you are ordering online or by telephone. Please read this document carefully and print it off or download it before placing your order.
We may change these terms from time to time. Please check them before you make a new purchase.

Booking an electrician

Whilst 99% of deliveries arrive on time we recommend you do not book an electrician until the goods are physically with you. We unfortunately cannot be held liable for any charges you may incur.

Payment

You can pay for your order by Visa, MasterCard, Delta/Connect, American Express, PayPal or Switch/Maestro. We will take all reasonable care to keep your order details and payment secure, but, unless we are negligent, we will not be liable for any losses if an unauthorised third party obtains access to your information.  Payment will be processed at the point of order in full and goods are dispatched usually the same day or within 24 hours weekdays.  If there is any issues with dispatching your order we will let you know as soon as possible, normally within 24 hours by email with specific details.

Your Agreement with Us

We will confirm acceptance (or otherwise) of your order as soon as possible, either by email (if your order is placed on-line). A binding agreement arises once we accept your order and we will then charge your credit/debit card on acceptance of your order.
We use Royal Mail/Parcel Force/DPD for all our deliveries but we do not accept responsibility for Royal Mail/Parcel Force/DPD delivery times.

Special Next Day Delivery Instructions

When placing an order, you may be able to upgrade postage so that your purchase will reach you the next postal day, you may also choose between 10am deliveries or next day Saturday for most items. Again, these are Royal Mail/Parcel Force/DPD services and we except no responsibility for their services, we will not offer any refunds for postal services unless the error is made by us. To use this service, you must place your order by 3pm to receive it the following day.

Delivery Times

We aim to have orders received before 2pm dispatched the same day. Any orders received after 2p.m maybe included in the next day post. Please note we may not always be able to dispatch the same day during busy times.
As we carry our most popular products in stock and we are usually able to offer a next day dispatch if required. However, due to the availability of some items, this may not be possible. If we have any problems with your order we will contact you to let you know the details and if urgent offer possible alternatives for faster delivery times.
*Working days do not include Saturdays, Sundays or public holidays.

Availability

All items are subject to availability. We can only guarantee availability whilst stocks last. If the goods ordered are unavailable, we will contact you with suggestions of goods of equivalent quality and wherever possible we will try and match or reduce the price. We will endeavour to deliver goods within the times stated but goods are subject to availability and delay in delivery of goods is sometimes out of our control.

Changing Your Mind & Unwanted Items

In compliance with the Distance Selling Regulations you have the right to cancel your order at any time before goods are delivered to you for any reason.
The Distance Selling Regulations also say, a consumer has 14 working days cooling off period to withdraw from a contract that they enter into with a supplier.
We want you to be absolutely delighted with your new product so we have extended this period to 30 days.
All we ask is that goods are returned unused in the original packaging and that you have taken reasonable care.
In all cases items being retuned must have all their original packaging, along with all accessories received with it, any sealed items must still be sealed and unused. We will refund the cost of your purchase including the delivery charge. However, we will not refund the cost of returning any items that are unwanted and if you request a collection this will be deducted from your refund.
We do really want you to be happy and if for some reason you decide you are unhappy with the goods after this 30-day period you may still be able to return the item and receive a credit note, this is done on a case-by-case basis. Please contact us and we will do all we can to help. A restocking fee may apply if the item has been opened, items that have been used will not be credited. Any credit notes issued must be used within 45 days of issue.
Please note our company does the offering of a credit note at our discretion, replacement items chosen are not subject to distance selling regulations rules regarding unwanted items and you will not be able to return them for a refund. We may again allow you to choose another item if you are still unhappy with your new item.
Exclusions from the 30 days return policy. For special orders i.e. items not normally stocked by us and requested by the customer and for bulk orders we will not accept returns. If you are ordering in bulk we would ask that you please order a sample to make sure you are happy with the item.
To notify us that you wish to return your goods please contact us via telephone. Once we receive your request we will send you an email with full details of how and where to return the goods including a returns number, which must be clearly displayed on the packaging.

Damaged or Missing Items

If you receive an item that is damaged on arrival or you are missing an item from your order, you will need to contact us either by phone or by e-mail within 48 hours of delivery of goods. We will then advise of our full returns procedure, and work to rectify this issue as quickly as possible for you.

Faulty Items

If you receive a faulty item or it becomes faulty whilst in its warranty period we will be happy to repair or if uneconomical replace the item.
In all cases you must first follow our simple returns procedure. First call us in some instances we may be able to provide information that cures the problem such as correct settings. If this is not the case we will send you a pre-paid label and returns number by email with full details of how to return the product.
Once we receive the product back a member of the returns staff will inspect and test the product. We will notify you of our findings and if the item is found to be faulty we will either repair or if not viable replace the item.
We process returns in the order they are received and we do try to have a repaired or replacement returned to you as soon as possible, normally within a few working days. However, in busy periods this may not be possible and it may take up to 10 working days.
Please note that items received without a returns number clearly displayed on the outside packaging may be refused.
On some occasions you may not be able to print off our pre-paid label, if this is the case you must return the parcel on a standard recorded delivery service. We will not refund any special next day delivery costs.
You must return the item safely and it is your responsibility to make sure the item is well packaged; if the item is broken in transit we will not be able to replace or repair the item. Postal companies will not cover poorly packed items. 

Complaints Procedure

If, in the unlikely event, you wish to make a complaint, then please contact us in writing and send it to our address shown in the “contact us” section.
We shall then fully investigate the matter and contact you within 5 working days from receipt of letter.
Law in addition to any warranties or conditions implies this guarantee and nothing in these terms affects your statutory rights.

Delay of Failure to Perform

We shall not be liable to you if we are prevented or delayed in our performing of any obligations to you if this is due to any cause beyond our reasonable control e.g.

  • an act of God, explosion, flood, fire or accident
  • war or civil disturbance
  • strike, industrial action or stoppages of work
  • any form of government intervention
  • a third-party act or omission
  • failure by you to give us a correct email or delivery address or notify us of any change of address

If this happens we shall inform you as soon as is reasonably practicable and if these circumstances continue for 30 days either you or we will be free to cancel the contract. If so, we will give you a full refund of any payment we have received from you within 30 days of cancellation.

CANCELLATION OF AN ORDER

Your rights when you end the contract will depend on what you have bought, whether there is anything wrong with it, how we are performing, when you decide to end the contract and whether you are a consumer or a business customer.
If you are ending a contract for a reason set out at (a) to (e) below the contract will end immediately and we will refund you in full for any Products which have not been provided and you may also be entitled to compensation. The reasons are:

  1. we have told you about an upcoming change to the Product or these terms which you do not agree to;
  2. we have told you about an error in the price or description of the Product you have ordered and you do not wish to proceed;
  3. there is a risk that supply of the Products may be significantly delayed because of events outside our control;
  4. if you are a business and we have suspended supply of the Products for technical reasons, or notify you we are going to suspend them for technical reasons, in accordance with clauses 32 and 33, in each case for a period of more than ninety (90) days; or
  5. you have a legal right to end the contract because of something we have done wrong.

If you are a consumer then for most Products you have bought online, by email, you have a legal right to cancel your order for the Product(s) which ends fourteen (14) days from the day you receive your Goods (“Cooling Off Right”). Any orders cancelled and Goods returned to the Company under this clause 71 will be fully refunded, including the cost of Basic Delivery as advertised on our website at the date of purchase. You do not have to give any reason for your change of mind under this clause.

Your right as a consumer to change your mind under clause 71 does not apply in respect of:

  1. Services, once these have been completed, even if the cancellation period is still running;
  2. any Products which become mixed inseparably with other items after their delivery.

Even if we are not at fault and you are not a consumer who has a right to change their mind, you can still end the contract before it is completed, but you may have to pay us compensation. A contract for Goods is completed when the Product is delivered and paid for. If you want to end a contract before it is completed where we are not at fault and you are not a consumer who has changed their mind, just contact us to let us know. The contract will end immediately and we will refund any sums paid by you for the Products not provided but we may deduct from that refund reasonable compensation for the net costs we will incur as a result of ending your contract.
To end the contract with us, please contact us.
If you end the contract for any reason after the Products have been dispatched to you or you have received them, you must return them to us. You must either return the Goods in person to where you bought them, post them back to us at LED HUT / Supreme Imports Ltd, Unit 4 Beacon Road, Trafford Park, Manchester, M17 1AF or (if they are not suitable for posting) allow us to collect them from you. If you are a consumer exercising your right to change your mind you must send off the Goods within 14 days of telling us you wish to end the contract.
We will pay for the costs of return:
If the Products are faulty or misdescribed; or
If you are ending the contract because we have told you of an upcoming change to the Product or these terms, an error in pricing or description, a delay in delivery due to events outside our control or because you have a legal right to do so as a result of something we have done wrong.

In all other circumstances you must pay the costs of return.

This applies in addition to the Cooling Off Rights above and applies to consumers. If you are not satisfied with the Products, you may return them within thirty (30) days from date of delivery subject to the Products being in a re-saleable condition. If you wish to return any of the Products after thirty (30) days from delivery, this will be at the sole discretion of the Company and only for Products that are faulty.
If you are entitled to a refund under these terms we will refund you the price you paid for the Products including delivery costs, by the method you used for payment. However, we may make deductions from the price, as described below:
If you are exercising the right to change your mind as a consumer we may reduce your refund of the price (excluding delivery costs) to reflect any reduction in the value of the Goods, if this has been caused by your handling of them in a way which would not be permitted in a shop. If we refund you the price paid before we are able to inspect the Goods and later discover that you have handled them in an unacceptable way, you must pay to us an appropriate amount.

WEEE Regulations

The Waste Electrical and Electronic Equipment (or WEEE) Regulations are now U.K. law. All European member States including the U.K. have agreed to reduce the amount of WEEE that is being disposed of in landfill sites.
It is important that the amount of WEEE sent to landfill sites is reduced because:
Some WEEE can be re-used or recycled. The amount of landfill space available in the UK is decreasing. If we can keep WEEE out of landfill sites it means there is more landfill space available for non-recyclable waste.
WEEE can contain hazardous substances. When left in landfill sites the hazardous substances in WEEE can pollute soil and contaminate water supplies. This contamination can damage human health and the environment.
Distributors of new Electric and Electronic Equipment (or EEE) have a part to play in reducing the amount of WEEE going into landfill sites.
Under the WEEE Regulations, all new electrical goods should now be marked with the crossed-out wheeled bin symbol shown below:
Goods are marked with this symbol to show that they were produced after 13th August 2005, and should be disposed of separately from normal household waste.

FORCE MAJEURE

The Company will not be liable to the Buyer in any matter or be deemed to be in breach of this contract because of any delay in performing or any failure to perform any of the Company’s obligations under this contract if the delay or failure was due to any cause beyond the Company’s reasonable control.
Without prejudice to the generality of above the following will be included as causes beyond the Company’s reasonable control:

  1. governmental actions, war, threat of war, national emergency, riot, civil disturbance, sabotage or requisition;
  2. act of God, fire, explosion, flood, epidemic or accident;
  3. import or export regulations or embargoes;
  4. labour disputes not including disputes involving the Company’s work-force; or
  5. inability to obtain or delay in obtaining supplies of adequate or suitable material, fuel, parts, machinery or labour.

Product Descriptions

We have made every effort to display as accurately as possible the colours of our products that appear on this Web Site. However, we cannot guarantee that your monitor’s display of any colour will accurately reflect the colour of the actual product.
While we try to be as accurate as possible, all sizes, weights and measurements quoted are approximate. Our website shows the price of goods and services inclusive of VAT plus delivery charges, (errors and omissions excepted). In the unlikely event that an incorrect price is shown on our website LightsStudio.co.uk reserves the right to abstain from fulfilling the order at that price.
The products sold on this Web Site have been designed to comply with the health and safety laws of the UK and we cannot warrant or represent that they comply with any health safety or other legal requirement outside the UK.

Governing Law

All contracts formed between us for the purchase of items from this Web Site shall be governed by English law and any dispute shall be subject to the jurisdiction of the English Courts.
If any provisions of these terms and conditions shall be unlawful, void or for any reason unenforceable then that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.
